Accountability: Sample Complaints

Below are two examples of bar complaints which were filed against New Orleans prosecutors in regards to their conduct while prosecuting the case State v. Michael Anderson.

These sample complaints provide a template for the structure and content that one might include in a bar complaint involving prosecutorial misconduct. Note that the ethical rules that prosecutors must follow differ somewhat from state to state, as does the process of initiating a complaint. Sample Complaint #1:

Sample Complaint #1 concerns allegations that prosecutors failed to disclose a deal that existed between the prosecution and a cooperating witness as well as allegations that prosecutors’ allowed that cooperating witness to testify falsely and failed to correct that false testimony.

Sample Complaint #2:

Sample Complaint #2 concerns allegations that prosecutors failed to disclose exculpatory evidence to the defense, including a videotaped statement by an alleged eyewitness to the crime that conflicted with that witness’ trial testimony, cast doubt on that witness’ credibility, and severely undermined the state’s case.
